Liverpool FC will attend the High Court tomorrow morning to seek to earn a ‘declaratory judgement’ ensuring that the LFC board acted in the best interests of the football club, and abided by the rules of the £280M loan from the Royal Bank of Scotland.
Mr Justice Floyd will oversee the case to take place in Court 18 sometime after 10.30am tomorrow.
For some time we have speculated that RBS were in no mood to re-finance the existing owners and the title of the case says it all.
Royal Bank of Scotland PLC v Hicks & ors
Liverpool FC are the last listed case of the day so a decision may not be known until early evening.
No matter the result – the losing side are expected to lodge an appeal.
Lord Grabiner QC will be representing the Liverpool board/RBS on behalf of club solicitors Slaughter & May. Paul Girolami QC of Maitland Chambers will act on behalf of Tom Hicks and co, representing Peters and Peters solicitors.
fingers crossed justice will be done tomorrow , goodbye hicks and gillette
i wonder if hicks and gillette will be there, will they face any fans there, hopfully there will be only one outcome a win for liverpool fc, and total defeat and humiliation for hicks and his lapdog gillette.
If, as seems to be the case, the proceedings are named as RBS v Hicks and others, then it seems that the matter will be limited to issues between those parties, i.e the debt issue, and not any internal dispute between Hicks/Gillet and Broughton and the remainder of the board
better to get an early judgment so if we do lose(which i dont think we will public feeling the way it is) we can appeal and broughton says he has a plan band c.
